MINUTES
I. The Meeting was called to Order by the President, Mrs. Giller at 6:01pm

II. RECOMMENDATIONS FROM THE SUPERINTENDENT – PERSONNEL
A. WHEREAS, Jose A. Havens (the “Employee”) is employed by the Cohoes City School District as a tenured health teacher; and
WHEREAS, on or about January 26, 2022, the Board of Education of the District disciplinary charges (the “Charges”) against the Employee pursuant to Education Law Section 3020-a; and
WHEREAS, in accordance with Education Law Section 3020-a, the Employee was required to request a hearing before an impartial hearing officer within ten (10) days of the preferral of the Charges; and
WHEREAS, in accordance with Education Law Section 3020-a the failure of the Employee to request a hearing constitutes a waiver of his right to a hearing; and
WHEREAS, the Employee failed to request a hearing within the statutory timeframe and therefore waived his right to a pre-termination hearing; and
WHEREAS, having reviewed the Charges preferred against the Employee and finding that there is sufficient evidence of the Employee’s guilt on said Charges, the Board hereby resolves as follows:
BE IT RESOLVED, that the employment of tenured health teacher Jose A. Havens is terminated in accordance with the provisions of New York State Education Law Section 3020-a effective immediately.
BE IT FURTHER RESOLVED, that the Superintendent of Schools is directed to take those reasonable steps as may be necessary to notify the Employee of the foregoing action of the Board of Education.
